INSURANCE LAW
Very many of our clients are concerned by issues
to do with the law on private insurance companies.
This includes issues of private health insurance,
private life and accident insurance and insurance
against occupational invalidity and disability.
Health insurance
One very contentious issue in the field of private
health insurance arises if an insurance company
seeks to withdraw from the contract or to challenge
it on the grounds of pre-contractual failure to
inform them of all relevant facts.
In the event they are called upon to make payment,
insurance companies check whether the client answered
the questions about his or her state of health
correctly when seeking to obtain insurance cover.
Insurers frequently withdraw from the contract
if they discover even minor inaccuracies –
often unfairly. The courts then have to decide
whether the insurer was actually entitled to withdraw
from the contract or not.
Another contentious issue in private health insurance
is the question of which medical services the
insurer is obliged to pay for.
Occupational disability insurance
Private life and occupational disability insurance
has been gaining increasing importance since the
state began withdrawing from retirement provision.
Insurance companies check very carefully whether
they are actually legally obliged to pay occupational
disability pensions.
Disputes frequently arise as to
- whether the insured party is actually unable
to work (as laid down by to the insurance conditions)
- whether the insured party can be expected
to seek work in another profession
- whether the insurance can withdraw from or
challenge the contract because of the insured
party's pre-contractual failure to inform them
of all relevant fact.
Accident insurance
Private accident insurance companies only pay
in the event of an accident. The amount involved
depends on the degree of disability.
Private accident pension insurance
Private accident pension insurance is often chosen
because it appears at first glance to be a cheap
alternative to occupational disability insurance.
As a rule, however, it only provides a lifelong
monthly pension if the degree of disability involved
is over 50%.
